Important Notes

1. Deko Canvas respects copyright laws so please make sure you own the rights or have permission to use any of the images you upload for us to print. We have the right to reject or refuse to print any images that do not follow copyright laws or that do not comply with our “user conduct” terms and conditions.

2. The files you upload are stored on our secure servers and may remain there for back-up purposes in case you need a reprint or your piece is damaged in shipment. If you want us to permanently delete your images from our server please let us know when you place your order and we will gladly comply. Otherwise files may be deleted off our server every three months without any notification. Make sure you back up your images.

3. The Files you send to us to be scanned will be returned to you, unless you specify otherwise. We can't be held responsible for original photos/artwork lost or deteriorated by shipping or third parties, after leaving our offices/warehouses.

Terms and Conditions

Effective Date: 1st November 2011

Welcome to the Deko Canvas , located at https://dekocanvas.com.sg (the "Website"), and maintained by Deko Canvas Pte Ltd Singapore . The current section contains the terms and conditions (T&C) that govern your use of the Website and the Deko Canvas services. This section of T&C describes your rights and responsibilities as well as what is expected by Deko Canvas . Use of the Deko Canvas Website constitutes your acceptance of and agreement to this T&C.

Deko Canvas reserves the right to add, delete and/or modify any of the terms and conditions contained in this T&C, at any time and in its sole discretion, by posting a change notice or a new agreement on the Website. In the event of substantive changes to this T&C, you may be notified by email. If any modification is unacceptable to you, your only recourse is to not use the Website and the Deko Canvas Service. Your continued use of the Website following posting of a change notice or new T&C on the Website will constitute your acceptance of the changes.

T&C will effect without deadline unless and until Deko Canvas chooses to terminate it.

Once the photo or digital image is submited to and edited by Deko Canvas, it becomes property of Deko Canvas . I agree to hold Deko Canvas harmless for any damages or loss to the photos or digital image. Upon placing an order, I agree to have Deko Canvas adjust my order on my behalf in the event that the order cannot be completed in a manner that Deko Canvas deems necessary to ensure customer satisfaction.

Deko Canvas cannot guarantee delivery times or dates due to circumstances beyond their control.

I consent Deko Canvas to reproduce and use the concerned photographs for use in all domestic and foreign markets. Further, I understand that others, with or without my consent, may use and/or reproduce such photographs. In addition, by participating, I am agreeing to the use of my photo or likeness for publicity, marketing, and sale purposes with no financial or other type of compensation. I hereby waive any right to inspect or approve any publicity materials produced. These publicity materials may be used at the discretion of Deko Canvas.

Deko Canvas reserves the right to refuse to print an item to canvas.

The customer agrees to fully indemnify and hold Deko Canvas harmless of, from and against any liability, loss, damages, costs and attorneys fees that may be alleged against or incurred by Deko Canvas as a result of any and all claims by third parties or law authorities related in any manner to customer images or Deko Canvas s manufacture of or fulfillment of orders for products bearing customer images regardless of whether or not Deko Canvas pre-screens the customer images.

Deko Canvas Service

Deko Canvas provides a number of Internet-based services through the Website (all such services, collectively, the " Deko Canvas Service" )One such service enables users to create and purchase customized products, including without limitation, framed and unframed canvas prints (collectively, "Products"). Deko Canvas users may create and purchase individual Products for their own use through the Deko Canvas Service.

Use of the Website and Deko Canvas Service

You must comply with all of the terms and conditions of this T&C, the applicable agreements and policies referred to below, and all applicable laws, regulations and rules when you use the Deko Canvas Service and the Website.

Deko Canvas solely and exclusively owns all intellectual property and other rights, title and interest in and to the Service and the Website, except as expressly provided for in these T&C.You will not acquire any right, title or interest therein under this T&C or otherwise to any intellectual property owned by Deko Canvas.

Deko Canvas grants you a limited revocable license to access and use the Website and it's Service for their intended purposes, subject to your compliance with this T&C. This license does not include the right to collect or use information contained on the Website for purposes prohibited by Deko Canvas - for competition purposes, to create derivative works based on the content of the Website,to download or copy the Website (other than page caching). If you use the Website in a manner that exceeds the scope of this license or you breach this T&C, Deko Canvas may revoke the license granted to you.

Deko Canvas may use third parties to provide certain services accessible through the Website. Deko Canvas does not control those third parties or their services, and you agree that Deko Canvas will not be liable to you in any way for your use of such services. These third parties may have their own terms of use and other policies. You must comply with such terms and policies as well as this T&C when you use those services. If any such terms or policies conflict with Deko Canvas T&C, agreements or policies, you must comply with Deko Canvas T&C , agreements or policies, as applicable.

General Rules

You may only use the Deko Canvas Service as expressly permitted by Deko Canvas. You are not allowed to harm to the Website or the Deko Canvas Service, specifically use any meta tags, search terms, key terms, or the like that contain Deko Canvas's name or trademarks.

By entering into this T&C, you agree to Deko Canvas collection, use and disclosure of your personal information in accordance with the Website's Privacy Policy.

Pricing

Prices of Deko Canvas products are are described on our website, on Prices section, and are part of this Terms and Conditions. All prices could be displayed on multiple currencies, as the products can be sold internationally.

Upload of files

As part of the Deko Canvas Service , Deko Canvas offers a service that allows you to upload images, photographs, graphic designs, and other content (collectively, "Content") to the Website to create, produce and purchase Products featuring the uploaded Content for your own use.

You will upload or deliver to Deko Canvas all Content that you want to use with the Deko Canvas Service in accordance with the applicable instructions on the Website. Deko Canvas may, in its sole and exclusive discretion, determine whether any Content complies with such instructions and is satisfactory for use with the Deko Canvas Service.

Shipping

If you purchase Products, you agree to do so in accordance with instructions provided on the Website. Title to the Products you purchase passes to you when the Products are delivered to the carrier.

Copyrights and Intellectual Property Policy

You will retain ownership of the Content that you upload to the Website. You hereby grant to Deko Canvas a royalty-free, worldwide, transferable, nonexclusive, right and license to use such Content, in all media existing now or created in the future, as Deko Canvas deems necessary to enable you to use the Deko Canvas Service to create, produce and purchase Products. Deko Canvas may sublicense the rights that you grant it in this Section to a third party subcontractor only for purposes of providing the Deko Canvas Service, processing your order, and producing and shipping your Products.

When you submit questions, comments, suggestions, ideas, message board postings, material submitted via web forms, contest entries, communications or any other information ("Submissions"), you grant Deko Canvas permission to use such Submissions for marketing and other promotional purposes, including the right to sublicense. You agree that Deko Canvas will have no obligation to keep any Submissions confidential.

You represent and warrant to Deko Canvas that, in your use of the Deko Canvas Service, you:

(I) will not infringe the copyright, trademark, patent, trade secret, right of privacy, right of publicity or other legal right of any third party

(II) will comply with all applicable laws, rules, and regulations.

You further represent and warrant to Deko Canvas that:

(I) there are no claims, demands or any form of litigation pending, or to the best of your knowledge, threatened with respect to any of your Content;

(II) Deko Canvas will not be required to make any payments to any third party in connection with its use of your Content, except for the expenses that Deko Canvas incurs in providing its service;

(III) the use of any instructions, formulae, recommendations, or the like contained in your Content will not cause injury to any third party;

(IV) your Content does not contain viruses or any other programs or technology designed to disrupt or damage any software or hardware.

Disclaimer of warranties

Deko Canvas provides the website and Deko Canvas service on an " as is" and " as available" basis. Deko Canvas does not represent or warrant that the website or it's use :

(I) will be uninterrupted

(II) will be free of inaccuracies or error

(III) will meet your requirements, or (iv) will operate in the configuration or with the hardware or software you use . Deko Canvas makes no warranties other than those made expressly in these T&C and hereby disclaims any and all implied warranties, including without limitation, warranties of fitness for a particular purpose, merchantability and non - infringement.

Limitation of Liability.

Deko Canvas will not be liable to you or any third party for any consequentiaon, incidental, indirect, punitive or special damages ( including damages relating to lost profits, lost of data or loss of goodwill ) arising out of, relating to or connected with the use of the Deko Canvas Service or this T&C, based on any cause of action, even if advised of the possibility of such damages. Except for a breach of party's representations and warranties under this T&C or in connection with your indemnity obligations under this T&C, in no event will the liability of either party in connection with this T&C exceed the greater of 200 SGD.

Termination

In its sole discretion, with or without notice to you, Deko Canvas may:

(I) suspend, limit your access to or terminate your use of the Website and/or the Deko Canvas Service.

(II) suspend, limit your access to or terminate your account.

(III) remove any of your Content from Deko Canvas servers and directories.

(IV) prohibit you from using the Deko Canvas Service and/or the Website.

If you or Deko Canvas terminates your use of the Website or the Service, Deko Canvas may delete any Content or other materials relating to your use of the Deko Canvas Service on Deko Canvas servers or otherwise in its possession and Deko Canvas will have no liability to you or any third party for doing so.
